The New York Times reports:
A panel of educators convened by the nation’s governors and state school superintendents proposed a uniform set of academic standards on Wednesday, laying out their vision for what all the nation’s public school children should learn in math and English, year by year, from kindergarten to high school graduation.
The new proposals could transform American education, replacing the patchwork of standards ranging from mediocre to world-class that have been written by local educators in every state.
Don’t be fooled. This is just another effort to subvert state sovereignty in the guise of “doing the right thing for our children.” Whether it be the Carter-era formation of the Department of Education, the Bush-era “No Child Left Behind” legislation, or the Obama-era “race to the top” program, the federal government has over the past century led a concerted effort to fully extend its reach over the entire arena of education. The problem is that the federal government has zero constitutional authority to be involved in the business of education, and the expanded federal role has not led to positive results. These acts have merely been blind, unconstitutional power grabs–not improvements for education.
Alaska and Texas are the only states that refused to participate in the standards-writing process. I say, “GOOD FOR THEM!” They are exerting their right under the Tenth Amendment to manage their own education systems and refusing to participate in an unconstitutional program. If only they would do the same in a whole host of other areas, we might be getting somewhere.
By participating in this program, states will be opening themselves up further to a floodgate of federal influence, and that is not a good thing. As I have already said, the federal government has no constitutional right to be involved in education, but there are practical concerns as well.
Massachusetts is already finding the standards to be a problem. Their state standards are actually higher than the uniformed ones being offered up. Should they lower them to fit in with the masses? Moreover, should any state compromise its current pursuits by adopting a program that cannot guarantee success.
At the heart of a free republic is the concept of localization. That is, local entities know their needs better than a central government. It is simple enough. Localization better addresses local problems because solutions are carried out within a local context. I am not saying that all states are doing a stellar job in education. In fact, no state can or will succeed in education without proper competition and market incentives. Indeed, we must meet the challenges of education, but meeting them locally will be the key.
Another problem that plagues the unified standards plan is a neglect of human action in education. Not only is it unreasonable to assume children can all be held to the same standards and achieve at similar levels, it is unreasonable to assume that students can achieve at all unless they are truly invested in their education. A Harvard-bound honor student and a slum-dwelling drug addict can be produced by the same schools with the same standards; it is the students, parents, teachers, and communities that make the difference. Until we realize that student achievement is not a direct result of dollars and programs, we will continue to see failed schools and wasted resources.
Look to the wealth of data if you are looking for empirical proof against government involvement in schools. There has been much policy research on the matter. I merely want to alert you to the fact that there is absolutely no convincing evidence that higher standards in education produce better results and point to the philosophical reasons you should be opposed to these latest educational developments.
The Boston Globe’s Jeff Jacoby rightly notes:
[T]he very nature of American society – a nation of 300 million comprising a multitude of ethnic, religious, social, and ideological traditions – argues against the imposition of one-size-fits-all education standards. There is no uniform answer to the question of what parents want most from their children’s education. “The greater the diversity of the people falling under a single schooling authority,’’ McCluskey observes, “the greater the conflict, the less coherent the curriculum, and the worse the outcomes.’’
Anyone who called for legislation to establish mandatory national standards for television programming or restaurant menus would be laughed at: Americans don’t think the government is competent to decide what shows they can watch on TV or what they can order for dinner when eating out. Is it any less risible to think that government knows best when it comes to your children’s education?
In fact, a uniform set of achievement standards will most likely have the same effect as more educational spending–public education will still produce the same results regardless of government influence. Only the cost and federal influence will increase.
This is an influence that we cannot afford. To solve our educational woes, the state should be getting out of the education business altogether. Funds should be returned to the taxpayers to educate according to their own desires. Private schools and home schooling already does an overall better job for a fraction of the price per student. It is prime time for privatization, but that will not occur in the near future. Until then we should be fighting back against centralized education attempts and unconstitutional federal action in a state’s matter.
As Jacoby concludes so will I:
Rather than centralizing even more government authority over the nation’s schools, genuine reform would move in the opposite direction. It is parents – not local, state, or federal officials – who should control education dollars. School and state should be separated, with schools being funded on the basis of their ability to attract students and teach them well. The primary responsibility for children’s education should be vested in the same people who bear the primary responsibility for their feeding, housing, and religious instruction: their mothers and fathers.
More government control is not the cure for what ails American schools. The empowerment of parents is. No teachers’ union, no school board, no secretary of education, and no president will ever love your children, or care about their schooling, as much as you do. In education as in so much else, high standards are important – far too important to hand off to the government.

Brussels – “We welcome the Woodruff County, Arkansas court finding that German corporation Bayer CropScience ‘intentionally’ contaminated US rice supplies. We applaud the decision requiring the company to pay Lennie Joe Kyle, the farmer who suffered losses when his rice was contaminated with Bayer’s genetically modified (GM) product, a total of US$1.3 million. This amount includes the first punitive damages for loss of future earnings ever awarded against Bayer.”
“The case is one of a raft of hundreds of cases stemming from the 2006 contamination of US rice supplies with Bayer’s experimental GM LL601 rice – an incident which continues to undermine US exports years later. The company has already been ordered by federal courts to pay four other farmers a total of US$3.5 million.”
“While we are pleased to see the courts step in to protect farmers and consumers when regulatory bodies fail, it is a pity that farmers have to go to these lengths to get satisfaction for their losses. As Mr. Kyle said, ‘It’s a lot to do with the way the big companies act. They think the farmer is just going to tuck his tail and take it, but we’re not going to anymore.’”
“GM is clearly an unpredictable technology that has proved both difficult to contain and damaging when it escapes. It is simply not necessary to take these chances with the safety of our food supply or the viability of our farms. It is important to see Bayer being held accountable for the damage they have done. Hopefully the court decision will act as a warning to other GM companies.”

Another state to feds: Take your gun regs and stuff ‘em
Local governments in massive revolt against rules ordered by Washington

Utah has become the third state to adopt a law exempting guns and ammunition made, sold and used in the state from massive federal regulations under the Bureau of Alcohol, Tobacco, Firearms and Explosives, and supporters say about 30 more states have some sort of plan for their own exemptions in the works.
Officials in Utah say they expect a lawsuit over their direct challenge to Washington if the federal government succeeds in its current case against Montana’s law.
Gary Marbut of the Montana Shooting Sports Association, who has spearheaded the Montana law, now describes himself as a sort of "godfather" to the national campaign. He confirmed Montana, Tennessee and Utah have enacted such laws.

"Wyoming and South Dakota, they have passed legislation and it’s on their governors’ desks," he said. "We learned today Oklahoma’s House has passed a plan over to the Senate. Idaho’s House has just passed it along. Alaska’s has passed the House and is in the Senate Judiciary committee," he said.
The move is about far more than just the regulation of handguns and shotguns, he said.

"It’s about states’ rights. Firearms are the vehicle, but the subject is states’ rights and an overbearing federal government," he said.
He said one of his sources of information for the Montana lawsuit compiled a list of states’ rights issues such as identification, sovereignty and gun licensing that was 20 pages long.
He confirmed an emerging consensus that the federal government’s role in making local decisions needs to be reined in.
"It is huge," he said. "We are glad the Firearms Freedom Act can be the point of the spear."
There only are about a dozen states that have not at least taken up the issue for discussion.
He noted other subjects also have become issues, such as regulations dealing with the sale of alcohol and tobacco.
Originally introduced and passed in Montana, the FFA declares that any firearms made and retained in-state are beyond the authority of Congress under its constitutional power to regulate commerce among the states.
The Salt Lake Tribune reported yesterday the Utah plan was signed into law by Gov. Gary Herbert.

"There are times when the state needs to push back against continued encroachment from the federal government. Sending the message that we will stand up for a proper balance between the state and federal government is a good thing," said Herbert in a statement.
The governor said he recognized the possibility of a lawsuit but said the cost can be minimized. In any event, Attorney General Mark Shurtleff said any case probably would be delayed until Montana’s decision is rendered, the newspaper reported.
The Utah plan was sponsored by Sen. Margaret Dayton, R-Orem. Dayton said, according to the Tribune, it "illustrates the universal yearning for freedom, and shows the people still feel the spark that inspired our ancestors at Lexington and Valley Forge. My hope is that the march toward tyranny can be turned back with our votes."
In Montana, officials filed suit against U.S. Attorney General Eric Holder and others seeking a court order that the federal government stay out of the way of Montana’s management of its own firearms within state borders.
In a recent filing, the federal government demanded dismissal of the action, explaining it can regulate in-state commerce under the Constitution’s Commerce clause.
As WND reported, the action was filed by the Second Amendment Foundation and the Montana Shooting Sports Association in U.S. District Court in Missoula, Mont., to validate the principles and terms of the Montana Firearms Freedom Act, which took effect Oct. 3.
Marbut argues that the federal government was created by the states to serve the states and the people, and it is time for the states to begin drawing boundaries for the federal government and its agencies.
The government’s latest filing in the case demands its dismissal, citing a lacking of "standing" for the plaintiffs and the court’s lack of "jurisdiction," as well as the Constitution’s Commerce Clause. The government filing argues, "The Supreme Court and Ninth Circuit have repeatedly held that even purely intrastate activities, such as those the MFFA purports to exempt from federal law, do affect interstate commerce and thus are within Congress’ power to regulate. As a result, even if plaintiffs had standing and jurisdiction existed, plaintiffs’ amended complaint fails to state a claim and must be dismissed."
The Commerce Clause, however, can be interpreted to have been amended by the 10th Amendment, which is part of the Bill of Rights, adopted subsequent to the U.S. Constitution, Marbut explains.
His organization said, "The Commerce Clause was amended – by the 10th Amendment. It is a bedrock principle of jurisprudence that for any conflict between provisions of a co-equal body of law, the most recently enacted must be given deference as the most recent expression of the enacting authority. This principle is ancient. Without this principle, laws could not be amended or repealed."
For example, U.S. courts repeatedly affirmed slavery before it ultimately was rejected.
There’s no question that the components of the Bill of Rights have authority: Just look at the 1st Amendment, Marbut explained.
The federal government had written gun dealers in Montana as well as in Tennessee when it adopted its own version of the same law that warned against following the state laws.
The letters were distributed to holders of Federal Firearms Licenses.
In the Tennessee case, Carson W. Carroll, the assistant director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, told dealers the Tennessee Firearms Freedom Act, adopted, "purports to exempt personal firearms, firearms accessories, and ammunition manufactured in the state, and which remain in the state, from most federal firearms laws and regulations."
The exemption is not right, the federal agency letter contends.

The government ran up the largest monthly deficit in history in February, keeping the flood of red ink on track to top last year’s record for the full year.
The Treasury Department said Wednesday that the February deficit totaled $220.9 billion, 14 percent higher than the previous record set in February of last year.

The Canadian dollar, or loonie as it is affectionately called here, is likely to soar above parity with the US greenback this year, experts at a Canadian bank said Wednesday.
Canadian Imperial Bank of Canada (CIBC) chief economist Avery Shenfeld said the Canadian dollar had already gained several cents in recent weeks as the market firms up expectations of an interest rate hike in July.
If as expected, the central bank "is out in front of the US Federal Reserve by a couple of quarters" in raising interest rates, the Canadian dollar could reach 1.02 dollars versus the US dollar by September, before dipping back to 0.97 dollars by year end," Shenfeld said.

Drawing on numerous documents about the CIA’s torture program that have been released over the past year, Mark Benjamin at Salon.com reports that interrogators went to extreme lengths to ensure that detainees were pushed to their physical limits, including feeding the detainees a liquid diet to make them more capable of ingesting large quantities of water, and replacing their water with a saline solution that would keep detainees from dying when they ingested too much water.

An Icelandic savings bank, Icesave, had attracted billions in deposits from hundreds of thousands of British and Dutch citizens, due to the phenomenally high interest rates it offered. Pursuant to Article I, Section 2, Clause 3 of the Constitution, the only information you are empowered to request is the total number of occupants at this address. My “name, sex, age, date of birth, race, ethnicity, telephone number, relationship and housing tenure” have absolutely nothing to do with apportioning direct taxes or determining the number of representatives in the House of Representatives. Therefore, neither Congress nor the Census Bureau have the constitutional authority to make that information request a component of the enumeration outlined in Article I, Section 2, Clause 3. In addition, I cannot be subject to a fine for basing my conduct on the Constitution because that document trumps laws passed by Congress.
